Man accused of assault

JOHNSTOWN A Johnstown man was charged Monday with assault and indecent exposure after a woman said he tried to rape her, city police said.

Officers said they responded to a 911 call around 4 a.m. at a residence along Grove Avenue.

When they arrived, a man inside warned, “If you come in this house, I will kill you.”

According to a court document, the man then said, “Wait a couple minutes; I have to get dressed.”

The suspect was identified as Edward Albert Kist, 57, of the 100 block of Gauntner Lane.

When the woman opened the front door, police said they found Kist putting on his pants.

The woman told police Kist tried to rape her.

According to police, Kist said, “I have a condom.”

The woman told police Kist had been drinking while they were watching television. She said Kist undressed and forced himself on her.

Kist was charged with unlawful restraint, terroristic threats, indecent exposure, simple assault, indecent assault and harassment.

He also was charged with possession of a controlled substance after police said they found a substance they believed to be marijuana in his pocket.

Kist was arraigned by District Judge John Barron of Upper Yoder Township and was freed after posting 10 percent of his $15,000 bond.

The woman’s name is being withheld by The Tribune-Democrat.
